Terms of Use (EULA)

This End User License Agreement ("EULA") is a legal agreement between you and The American Towing & Recovery Institute. This EULA governs your use of the EV-Clever application ("App") provided by The American Towing & Recovery Institute.

You indicate acceptance of these terms by your continued use of The American Towing & Recovery Institute. (“The American Towing & Recovery Institute”,“We”,“Us” or ”Our”) services (“Services”) which includes the Web site located at ev-clever.com (the ”Site”) mobile phone applications (“Mobile”) including the applications published under The American Towing & Recovery Institute accounts.

Please read this agreement carefully before using the services. By using the services you accept the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, you will not have any right to use the services. The American Towing & Recovery Institute acceptance is expressly conditioned upon your assent to all the terms and conditions of this agreement, to the exclusion of all other terms; if these terms and conditions are considered an offer by The American Towing & Recovery Institute, acceptance is expressly limited to these terms.

The purpose of the Site and Mobile applications, owned and operated by The American Towing & Recovery Institute, is to provide reference guide for all electric vehicle rescue & recovery services. The Site and Mobile applications are accessed by you ("User" or "you") under the following terms and conditions:

By downloading, installing, or using the App or website, you agree to be bound by the terms and conditions of this EULA. If you do not agree to the terms of this EULA, do not use the App or Website.

The American Towing & Recovery Institute grants you a limited, non-exclusive, non-transferable, revocable license to use the App or Website for personal, non-commercial purposes, strictly in accordance with the terms of this EULA.

You agree not to, and you will not permit others to:

• License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the App.
• Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App.
• Use the App in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with this EULA.

The American Towing & Recovery Institute reserves the right to modify, suspend, or discontinue, temporarily or permanently, the App or any service to which it connects, with or without notice and without liability to you.

The App, including without limitation all copyrights, patents, trademarks, trade secrets, and other intellectual property rights therein, are the sole and exclusive property of The American Towing & Recovery Institute.

The American Towing & Recovery Institute collects, stores, maintains, and shares information about you in accordance with our Privacy Policy. By accepting this EULA, you acknowledge that you hereby agree and consent to the terms and conditions of our Privacy Policy.

The App may display, include, or make available third-party content (including data, information, applications, and other products, services, and/or materials) or provide links to third-party websites or services. You acknowledge and agree that The American Towing & Recovery Institute shall not be responsible for any third-party services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality, or any other aspect thereof.

This EULA is effective until terminated by you or The American Towing & Recovery Institute. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination of this EULA, you must cease all use of the App and delete all copies of the App.

The App is provided on an "AS IS" and "AS AVAILABLE" basis, with all faults and without warranty of any kind. To the maximum extent permitted under applicable law, The American Towing & Recovery Institute expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the App.

To the fullest extent permitted by applicable law, in no event shall The American Towing & Recovery Institute be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party.

This EULA and your use of the App are governed by and construed in accordance with the laws of any country including the country in which you are resident or from which you use the Services, excluding its conflicts of law rules.

The App offers auto-renewable subscriptions. By subscribing, you agree to the following terms:

Free Trial: The App provides a 30-day free trial. At the the end of each term (month,year), the subscription will automatically renew at a rate of $2.99 per month for monthly subscription or $19.99 per year for yearly subscription unless canceled at least 24 hours before the end of the trial period.

Auto-Renewal: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at a rate of $1.99 per month for monthly subscription or $19.99 per year for yearly subscription.

Cancellation: You may manage and cancel your subscriptions by going to your Account Settings after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription, where applicable.

Payment: Payment will be charged to your Apple ID account at confirmation of purchase.

Changes to Subscription Terms: The American Towing & Recovery Institute reserves the right to modify the subscription terms at any time, with reasonable notice to you of any changes.
